Consumer (Guest) Terms of Use

Effective date: 17 June 2026

PLEASE READ THESE TERMS CAREFULLY. They form a legally binding agreement between you, the individual using the service as a consumer (the "Guest", "you"), and TabbPay. By scanning the QR code, accessing or using the Service you accept these Terms without reservation. If you do not agree, please do not use the Service.

These Terms are read together with the Privacy Policy and the Cookie Policy.

2. What the Service Is and TabbPay's Role

2.1 TabbPay provides only the technology interface that lets you view the Venue's menu, place an order, split and settle your bill, and leave a review.

2.2 The contract for the purchase of food and beverage products and services is concluded directly between you and the Venue, not with TabbPay. The Venue is the seller and is solely responsible for the products, their quality, preparation, ingredient and allergen labelling, pricing, fulfilment and delivery of the order, and compliance with food-safety and hygiene law.

2.3 TabbPay does not prepare, sell or deliver food or drink, is not a party to your order, and does not control the availability, price or quality of the products.


3. Ordering and Confirmation

3.1 Your order is transmitted to the Venue through the Service. Acceptance and fulfilment of the order rest with the Venue.

3.2 You must provide accurate information (e.g. table number) and check your order details before submitting. Any special requirements (e.g. allergies) must be confirmed directly with the Venue.


4. Prices, Payment and Tips

4.1 Prices are set by the Venue and shown in the Service inclusive of VAT where applicable.

4.2 Payment is processed securely by the Payment Provider and credited to the Venue's account. TabbPay does not access, store or handle your card details or your money; payment data is held exclusively by the Payment Provider under PCI-DSS certification.

4.3 Tipping is optional and is paid to the Venue or its staff according to the Venue's settings.

4.4 Refund requests, charge disputes, or incorrect/incomplete orders are resolved with the Venue as seller. TabbPay may provide technical assistance on request.


5. Right of Withdrawal

5.1 You are informed that, under consumer-protection law (Article 3ιβ of Law 2251/1994, which transposes Article 16 of Directive 2011/83/EU), the 14-day right of withdrawal does not apply to the supply of food and beverages intended for immediate consumption — being goods liable to deteriorate or expire rapidly and goods made to the consumer's order — nor to catering and leisure-related services tied to a specific date or period of performance. Orders for immediate consumption are therefore binding once accepted by the Venue.

5.2 The above does not affect your statutory rights against the Venue in the case of a defective or non-conforming product.


6. Returning-Customer Recognition and Loyalty (Optional)

6.1 Where the Venue enables it, you may optionally verify your mobile number (via a one-time SMS code), be recognised as a returning customer, and join a loyalty programme. Participation requires your consent, which is revocable at any time.

6.2 The loyalty programme is provided by and on behalf of the Venue; the terms, value and redemption of points are set by the Venue. Points are not money, have no cash value and are not redeemable for cash.

6.3 The related data processing is described in the Privacy Policy; TabbPay acts as a processor on behalf of the Venue.


7. Reviews and User Content

7.1 When you submit a review, rating or comment, you represent that it is truthful, based on a genuine experience, and not unlawful, offensive, defamatory or misleading, and does not infringe third-party rights.

7.2 You grant TabbPay and the Venue a non-exclusive, royalty-free licence to use, reproduce and display the User Content to operate and improve the Service. TabbPay may remove User Content that breaches these Terms or the law.


8. Acceptable Use

You must not: (a) use the Service for any unlawful or fraudulent purpose; (b) submit false orders or payment details; (c) interfere with the security or operation of the Service; (d) attempt unauthorised access; or (e) use automated means in a way that disrupts the Service.


9. Personal Data

The processing of your data is described in the Privacy Policy. For the core ordering/payment functions and loyalty, TabbPay acts as a processor on behalf of the Venue; for platform security and operation it acts as an independent controller.


10. Intellectual Property

The Service, its software, design, trademarks and content (other than User Content and Venue content) belong to TabbPay. You are granted no rights beyond the temporary use of the Service for the purposes of these Terms.


11. Availability — Disclaimer of Warranties

TabbPay makes reasonable efforts to keep the Service available but does not warrant uninterrupted or error-free operation. The Service is provided "as is" and "as available", to the extent permitted and without prejudice to the mandatory rights of the consumer.


12. Liability

12.1 TabbPay is liable for damage caused by its own fault in operating the Service, in accordance with applicable law. Nothing in these Terms limits or excludes liability that may not be limited or excluded under mandatory law (in particular liability for wilful misconduct or gross negligence, or for harm to life, bodily integrity or health).

12.2 TabbPay is not liable for the acts or omissions of the Venue, in particular for the quality, safety or legality of the products, the fulfilment of the order, or related tax obligations, which rest solely with the Venue.

12.3 TabbPay is not liable for interruptions caused by third-party providers (e.g. networks, the Payment Provider, infrastructure) or by force-majeure events.


13. Complaints and Dispute Resolution

13.1 Complaints about the order, products or payment are addressed to the Venue as seller. For technical issues with the Service you may contact TabbPay at support@tabbpay.com.

13.2 As a consumer you may turn to the Hellenic Consumer Ombudsman (Συνήγορος του Καταναλωτή, www.synigoroskatanaloti.gr) or to a certified Alternative Dispute Resolution (ADR) body. Recourse to ADR does not affect your right to bring proceedings before the courts.


14. Amendments

TabbPay may amend these Terms, in particular for legal or operational changes. The version in force bears the date in the header. Continued use after publication constitutes acceptance, without prejudice to your mandatory rights.


15. Governing Law and Jurisdiction

These Terms are governed by Greek law. The mandatory consumer-protection provisions of your country of habitual residence are not affected. Jurisdiction is determined by law; as a consumer you retain the right to bring proceedings before the courts of your place of residence.

These Terms are issued in Greek (the binding version) and in English (a convenience translation); in the event of any divergence the Greek version prevails, save that this does not deprive you of the mandatory protections referred to above.
